Council Exemptions

New Zealand Building Consent Rules for Awnings & Roofed Patios

Under Schedule 1 of the Building Act, adding a permanent polycarbonate roof or heavy tension membrane changes a pergola's legal definition to an awning or veranda, which enforces specific size restrictions.

Small-Scale Awnings
Up to 20sqm (Exempt)

Any attached awning or veranda up to 20 square metres on the ground floor or first storey does not require a building consent. No professional sign-off is legally required for this bracket.

Medium-Scale Awnings
20 to 30sqm (LBP Sign-off)

Awnings between 20 and 30 square metres on the ground floor do not require building consent provided the design and construction are carried out or supervised by a Licensed Building Practitioner (LBP).

Large-Scale Engineering
20 to 30sqm (CPEng Sign-off)

Alternatively, awnings between 20 and 30 square metres are exempt on the ground floor if the structural design is formally carried out or reviewed by a Chartered Professional Engineer (CPEng).

Mandatory Compliance Restrictions

Strict conditions that must be met to bypass council consent.

If your system breaks any of the following rules, a full Building Consent is legally required before installation begins.

No Public Overhang

The structure must not overhang any area accessible by the general public. This includes private commercial properties with limited public access, such as restaurant courtyards, cafes, or bars.

Boundary Setbacks

The structure must adhere strictly to your local district plan or Auckland Unitary Plan height-in-relation-to-boundary rules and standard yard setbacks.

Ground & First Storey Limit

To remain consent-exempt, the awning must only be installed on the ground floor or the first-storey level of the host building. Third-floor installations (such as apartment balconies) automatically require a building consent.

Mandatory NZ Building Code Structural Clauses

Even when exempt from building consent, all permanent polycarbonate and tension systems must satisfy these core performance parameters of the New Zealand Building Code.

Wind & Snow Load

System framing, support arms, and fixings must be custom-engineered to withstand self-weight structural stresses and regional environmental loads, including high-velocity Auckland wind zones and sudden snow or hail loads.

Clause B2 – Durability
5 to 15 Years

Building elements must maintain structural integrity for their targeted lifespan. Polycarbonate sheet profiles and support structures must remain clear, non-brittle, and fully functional for at least 15 years when subjected to normal use and routine maintenance.

Clause E2 – External Moisture
Weathertightness

All physical fasteners, coach screws, or structural brackets that penetrate a building's cladding envelope must possess robust flashing or watertight seals to completely prevent internal water leaks.

Clause F2 – Hazardous Building Materials
Impact Safe

Polycarbonate panels must demonstrate safe impact behavior under stress, ensuring they do not shatter or release hazardous fragments during severe storm conditions or tree debris impact.
